1. Introduction

Welcome to Smophy AI ("the Platform"). Smophy AI is owned and operated as a brand of Smophy Labs Inc. ("we," "our," or "us").

By accessing or using Smophy AI via chat.smophy.ai or any related services, you ("User," "you") agree to be bound by these Terms & Conditions, our Privacy Policy, and any additional policies we may introduce. If you do not agree, you must discontinue use immediately.

2. Services Provided

Smophy AI provides access to premium artificial intelligence services, including interactions with AI platforms such as Grok, ChatGPT, Gemini, DeepSeek, Claude, Perplexity, and AI-powered tools for:

  • Prompt Enhancement
  • Image Generation (limited models based on availability)
  • Audio Transcription

Your subscription includes 5,000,000 (5 million) tokens monthly, renewable each billing cycle. Unused tokens do not roll over unless specifically stated.

3. Subscription Plans & Pricing

  • Monthly: USD $19.98
  • Yearly: USD $199.8

Prices are inclusive of applicable taxes. We reserve the right to change subscription pricing with prior notice.

4. Payment Processing

All payments are processed globally by Stripe, Inc. and/or its affiliated entities. We do not directly collect or store full payment card details.

You are responsible for ensuring billing information is accurate and up to date. Failed or reversed payments may result in suspension or termination of access.

5. Refund & Cancellation Policy

All payments are non-refundable, regardless of usage. Cancellation prevents future billing but does not entitle you to a refund for the current billing cycle.

Exceptions may only apply if required by applicable law.

6. Token Usage Policy

Definition of Tokens

A token refers to a unit of text-processing capacity consumed when sending prompts and receiving AI responses.

Monthly Token Allocation

Each subscription includes 5,000,000 tokens per month. Tokens reset at the start of each billing cycle and do not roll over.

No Cash Value

Tokens have no monetary value and cannot be refunded, transferred, exchanged, or converted.

Excess Token Usage

Once tokens are exhausted, services may be limited or paused. Smophy AI is not liable for interruptions caused by usage limits.

7. Intellectual Property

All materials, brand assets, Smophy AI’s name, logo, and proprietary tools are the intellectual property of Smophy Labs. Unauthorized reproduction or resale is prohibited.

8. Restrictions on Use

  • Use the platform for illegal activities
  • Reverse-engineer or scrape the platform
  • Share or resell account access
  • Generate harmful or discriminatory content

9. Acceptable Use Policy (AUP)

Violations of acceptable use — including illegal, abusive, infringing, or harmful content — may result in suspension or permanent termination without refund.

10. Content Ownership & Usage Rights

You retain rights to lawful Outputs you create. However, Outputs are subject to third-party AI provider terms.

You grant Smophy AI a non-exclusive license to process prompts and Outputs solely to provide and improve services.

11. Disclaimer of Third-Party Services

Smophy AI integrates third-party AI technologies. Their respective terms and policies also apply.

12. Limitation of Liability

The platform is provided on an "as is" basis. To the maximum extent permitted by law, Smophy Labs shall not be liable for damages arising from use of the services.

13. Age & Parental Consent

Smophy AI is not directed toward children under 13 (US) or 16 (EU unless lowered by local law).

14. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. No refunds will be issued for violations.
